TERMS OF SERVICE

Thank you for investing the time to go through this information. This is intended to safeguard both my interests as an artist and yours as a customer or client. When you commission me, you inherently consent to my Terms of Service (T.O.S). Failure to review or adhere to my T.O.S will lead to your inclusion in my blacklist, and subsequent commissions will not be accepted.

I. COPYRIGHT & USAGE

THE ARTIST:-All rights to the commissioned work, encompassing distribution, reproduction, self-promotion, and display on public sites, are retained by me.-I do not claim ownership or credit for the design of characters featured in the commission.-I reserve the right to decline any request without providing further explanation, and this decision may be made for any reason.-I reserve the right to modify my Terms of Service at any given time.

THE CLIENT:-Commissions are intended for personal use only, such as gifts, wallpapers, personal prints, icons, headers, profile pictures, and posting on social media platforms with proper credit to the artist (@PokaPoka__kun or a link to my public profile).-If you prefer to keep your commissioned work entirely private, please inform me in advance.-Personal commission: You are strictly prohibited from generating profits in any form from the commissioned piece (reselling, redistributing, uploading to POD services, creating prints, reposting for promotional purposes, etc.).-Drafts and progress photos provided are for commissioning purposes and personal use only (as mentioned above). They must not be used for commissioning other artists, traced, altered, edited, or claimed as the commissioner's creation.-If there is uncertainty regarding any use of the commission, kindly seek direct permission from me.-The commission must not be utilized in any blockchain technology, including NFTs, cryptocurrencies, and any future innovations in this field.

II. PAYMENT

-Accepted currency is USD, and payment is facilitated through PAYPAL via PayPal invoices.-Full payment must be completed before I commence work on your commission.-Payment plans are available for amounts exceeding $150, with a duration of one to two weeks for full payment.-Please refrain from making any payment until I have confirmed acceptance of the commission.

III. PROCESS & DELIVERY

-Please provide both visual and textual references when submitting your commission request. Commissions based solely on text descriptions or unclear reference sheets, such as messy sketches or blurry details, will not be accepted. It is essential to describe your request thoroughly to ensure a smooth process.-The timeframe for completing a commission may vary depending on its complexity, typically ranging from 5 days to 1 month.-I will present the work in stages, including the rough sketch, line art, and a draft with rough colors, followed by the finished piece.-A maximum of three revisions is allowed. During our initial discussion, we will explore the concept, idea, and compile a reference list for all details to be included in the artwork, such as color palette, character traits, clothing references, and character vibes.-Rough Sketch-
-While working on this phase and incorporating your requested changes, I will not wait for any late alterations. Please carefully consider your revisions during this phase, as the same policy applies in subsequent stages.[First revisioned drawing]
-After presenting the first revisioned sketch, any changes should be carefully considered, as the next progress preview will feature the line art with base colors. Changes made during the line art phase may incur an additional fee, depending on their complexity.[2nd revisioned Clean digital Line art with base color ]
-This phase allows for one-time color revisions before progressing to the full cell-shaded coloring phase.
-Revisions are confined to the agreements made in the commission form. Major changes or requests for a different concept cannot be accommodated after sketch approval. Additional revisions may be subject to an extra fee, as mutually agreed upon.-If there is an error in the character's design, I will rectify it free of charge, provided the missing detail is clearly visible on the reference sheet or specified in the text description. Minimal changes, such as my mistakes that you identify and communicate, are acceptable at any stage of the work.-The final commission will be delivered via email, Discord, or an online download location in .png format. However, working files (.psd, .csp) are not included. The delivered file will be of the highest resolution and include a small watermark.

IV . ADoptable commission

-Please note that there is a distinction in pricing between the Customize Adoptable Commission and the Commercial Custom Adoptable Commission. Specifically, the price for the Custom Adopt is tripled when utilized for commercial purposes.-The cost of the Customize Adoptable Commission is variable and depends on the complexity and detail of the character customization you desire, as well as whether you include a character sheet.-It is strictly prohibited to use my Customize Adoptable Commission for any commercial purposes unless a commercial commission has been purchased and duly compensated for.

V. refunds

🔳You can only get refunds for YCH commissions, regular commissions, and customized adoptable commissions. Refunds will have deductions based on updates, time, files sent, line art, flat color bases, and the effort I've put in. You're not allowed to use my bases or updates in your references for other commissions, and I have the right to sell these poses since you canceled the commission.🔳 Once you've made a deal or bought adoptables from me and everything has been settled, refunds won't be possible. Remember, you agree to my terms when you purchase adoptables from me.🔳 You need to agree to the refund schedule we discussed because I need time to sell my adopts and commissions. The refund may take around 15 days to 1 month. I have bills and other essential expenses to manage. I'd suggest to not open a dispute case; instead, I'll directly send the refund as agreed.🔳A full refund can be requested prior to the initiation of work on the commission. If the request is canceled during the sketch stage, 50% of the paid price will be retained.🔳No refunds will be processed once the sketch has been approved or after the final product has been delivered. Refunds are not applicable for disliking the commission or experiencing a change of mind; this is mitigated by providing drafts and progress photos throughout the creative process.🔳In the event that I am unable to complete the commission for any reason, a full refund will be issued, and all rights to the unfinished commission will be reclaimed (meaning you cannot use the provided drafts and progress photos under any circumstances).

⚠️Engaging in the described actions is strictly forbidden, and this applies to both commissions and adoptables.⚠️

⚠️ Copying or tracing any of my artworks.
⚠️ Editing or cropping the images and merging them.
⚠️ Downloading the artwork to remove my signature.
⚠️ Trying to sell the artwork/adoptable after it has already been purchased and
rightfully belongs to the owner is prohibited.
⚠️ Falsely assert authorship of the original design.
⚠️ Engaging in illegal activities.
⚠️ Stealing or claiming someone else's art as your own.
⚠️Claiming ownership of my client's OC's copyright.
⚠️Uploading the file elsewhere without the artist's consent.

I may revise my terms of service in the future to incorporate any additional elements I deem necessary.
